Participação indígena na regulação jurídica dos conhecimentos tradicionais associados à biodiversidade

Abstract

This paper intends to investigate the means of participation of indigenous people in the political field concerning the regulation by law of traditional knowledge related to biodiversity. The regulation of access and use of genetic resources and traditional knowledge concerns to a field of disputes characterized by a multiplicity of institutions and social agents. Government entities, NGOs, social movements, companies and universities take part in the polemic themes that remark this mentioned process of regulation by law. This paper focus on the indigenous participation in this process and the effects of their performance with the State and the appropriate law instruments (like laws, decrees and resolutions) and intends to demonstrate the limits of the right of participation recognized by the Democratic State of Law.
