| metadata.dc.description.resumo: | O presente trabalho tem por objetivo analisar a atual política do salário mínimo brasileiro considerando o conceito de Estado de Coisa Inconstitucional. Busca-se levar à reflexão o fato de que o valor nominal estipulado não é suficiente para o atendimento de itens básicos da necessidade humana fazendo com que muitos trabalhadores tenham de abdicar de alguns itens necessários à sua sobrevivência para dar lugar aos que consideram de maior urgência, perpetuando, dessa maneira, o agravamento da desigualdade econômico-social por um problema decorrente da dificuldade estatal em cumprir o que preceitua a Constituição Federal. Por tais razões, o presente artigo propõe-se a analisar e discutir a incidência do Estado de Coisas Inconstitucional no salário-mínimo brasileiro, bem como demonstrar a problemática que a omissão estatal gera na manutenção da atual política. Para isso, utilizou-se o método dedutivo e bibliográfico. |
| Abstract: | This paper aims to analyze the current Brazilian minimum wage policy considering the concept of States of Unconstitutional Thing. We seek to reflect on the fact that the nominal value stipulated is not sufficient to meet basic items of human need, causing many workers to have to give up some items necessary for their survival to make room for those they consider most urgent, thus perpetuating the aggravation of economic and social inequality due to a problem resulting from the state's difficulty in complying with what the Federal Constitution prescribes. For these reasons, the present article proposes to analyze and discuss the incidence of the Unconstitutional State of Things in the Brazilian minimum wage, as well as to demonstrate the problem that the state omission generates in the maintenance of the current policy. For this, the deductive and bibliographic method was used. |
